The Site is intended for businesses and professionals. By using it, you represent that you are at least 18 years of age. If you use the Site on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms, and references to "you" include that entity.
3. Purpose of the Site
The Site presents World Sports City and the software development, automation, applied Artificial Intelligence, infrastructure, digital marketing, consulting, and training services we provide. Its content is informational and does not constitute a binding commercial offer.
The provision of any service, including its scope, timelines, price, and conditions, is subject to a proposal and an agreement in writing, accepted by both parties. If that agreement conflicts with these Terms, the agreement controls.
4. Permitted Use
You may browse the Site, print pages, and share links to it for lawful and informational purposes. You may not:
- use the Site in violation of any applicable law or regulation;
- attempt to access the Site, the servers that host it, or connected systems without authorization, or test them for vulnerabilities without our written authorization, including for purposes of the Computer Fraud and Abuse Act (18 U.S.C. § 1030);
- impair the operation of the Site or overload it, including by means of automated requests;
- systematically copy or extract content from the Site, whether by automated or manual means;
- introduce viruses or any other malicious code;
- impersonate World Sports City or suggest an affiliation with us that does not exist;
- use our email addresses to send unsolicited commercial communications.
5. Intellectual Property
The text, design, logo, images, and code of the Site are owned by World Sports City or are used with the authorization of their respective owners. They are protected by the copyright law of the United States (17 U.S.C.), by trademark law (Lanham Act, 15 U.S.C. § 1051 et seq.), and by applicable international treaties.
Except as provided in Section 4, you may not reproduce, modify, distribute, or commercially exploit any content of the Site without our written authorization. The World Sports City name and logo identify the company and may not be used without that authorization. Nothing in these Terms grants you any license to them.
Ownership of what we develop for each client is governed by the applicable written agreement, and not by these Terms.
6. General Information, Not Advice
The content of the Site is general in nature and may not be complete or current. It does not constitute technical, legal, financial, or any other kind of advice for your specific situation, and you should not base decisions on it without your own analysis or without engaging us for that purpose.
7. Communications with Us
Writing to us does not create a contractual or client relationship. Until a confidentiality agreement has been signed, we ask that you not send us confidential or strategic information: without such an agreement, we cannot guarantee confidential treatment. How we handle the personal information you send us is described in the Privacy Policy.
8. Third-Party Links and Trademarks
The Site may contain links to third-party websites. We do not control those websites and are not responsible for their content, availability, or privacy practices.
The Site mentions third-party products and services, such as Google Workspace, Microsoft 365, Claude, Make, n8n, WhatsApp Business, Power BI, and Looker Studio. These trademarks belong to their respective owners. We refer to them solely to describe the technologies we work with, and doing so does not mean that there is any partnership with, or sponsorship or endorsement by, those owners.
9. Disclaimer of Warranties
THE SITE AND ALL OF ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORLD SPORTS CITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, ERROR-FREE, OR FREE OF VIRUSES, OR THAT ITS CONTENT IS COMPLETE OR CURRENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORLD SPORTS CITY AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND SERVICE PROVIDERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOSS OF DATA OR BUSINESS, ARISING OUT OF ACCESS TO, USE OF, OR INABILITY TO USE THE SITE, EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, WORLD SPORTS CITY'S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those cases, the above exclusions and limitations apply only to the extent permitted by law. This Section relates to the Site. Liability relating to contracted services is governed by the applicable written agreement.
11. Indemnification
You agree to indemnify and hold harmless World Sports City and its members, managers, and employees from and against claims, losses, and reasonable expenses, including attorneys' fees, arising out of your unlawful use of the Site or your breach of these Terms.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, United States, and by applicable United States federal law, without regard to conflict of laws rules. Any dispute relating to the Site or to these Terms will be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, and both parties consent to that jurisdiction.
Nothing in these Terms excludes rights granted to you by mandatory laws of the country in which you reside that cannot be excluded by contract.
13. Changes
We may change these Terms and the Site at any time. The version in effect is the one posted on this page, with the date of the most recent update at the top. Changes take effect upon posting. If you continue to use the Site after that, you will be deemed to have accepted the new version.
14. General Provisions
- Severability. If any provision is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
- No Waiver. Our failure to exercise any right under these Terms does not constitute a waiver of that right.
- Assignment. We may assign our rights and obligations under these Terms. You may not assign yours without our written consent.
- Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between the parties with respect to the use of the Site.
- Headings. Section headings are for convenience only and do not affect interpretation.
- Language. These Terms are available in English, Portuguese, and Spanish. Translations are provided for convenience only. If there is any conflict between versions, the English version controls.
